IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 29.03.2019

CORAM:

THE HONOURABLE MS.JUSTICE P.T. ASHA C.R.P. PD No.1244 of 2019 and CMP No.8014 of 2019 Chakalakonda Rupadevi ... Petitioner

Versus

Chakalakonda Sandilya Prachodhe ... Respondent Prayer: Civil Revision Petition filed under Article 227 of the Constitution of India against the order dated 18.03.2019 made in I.A. No.1 of 2019 in H.M.O.P. No.505 of 2016 on the file of Principal Family Court, Chennai. For Petitioner : Mr.Ravisankar

ORDER

The above Civil Revision Petition is filed challenging the order passed in I.A. No.1 of 2019, which is an application filed by the respondent / husband under the provisions of the Order IX Rule 7 to set aside the ex-parte order dated 10.01.2019. It is seen from the records that the said petition has been immediately filed, without any delay and the order has been passed immediately.

2. I do not find any infirmity in the order passed by the learned Judge, who has observed that considering the conduct of the petitioner in co-operating with the Court for concilation proceedings, despite the fact that he is out of the country and also taking note of the submissions made on either side, has allowed the application. The reasoning cannot be countenenced. Hence, the Civil Revision Petition stands dismissed.

3. It is seen that the matrimonial dispute is pending before the learned Judge, from the year 2016, the learned Principal Judge, Family Court, Chennai, is directed to dispose of OP No.505 of 2016 along with HMOP No.832 of 2017, within a period of four months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed. 29.03.2019 Internet: Yes/No Index: Yes/No Speaking order/Non-speaking order vsi2
