O R D E R

The Criminal Original Petition has been filed to direct the second respondent to register a case, on the complaint dated 24.06.2016, given by the petitioner and to investigate the same.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. On a reading of the complaint dated 24.06.2016, it is seen that this petitioner had obtained vehicle loan from the opposite party in the year 2013, and it is stated by the petitioner that he had completely paid the loan, but the opposite party is not returning the RC book. The petitioner has further stated that the opposite party threatened the petitioner that he will be murdered.

4. The learned Additional Public Prosecutor submitted that on the complaint given by the petitioner, petition enquiry is pending in CSR.No.161 of 2016.

5. The petitioner has not even stated the date on which the said threat was given. Since, the dispute essentially appears to be civil in nature, no positive direction can be issued to the second respondent-police to register an FIR. In view of the above, this Criminal Original Petition is closed.
