Angamuthu @ Gurusamy v. The State Rep.By The Inspector Of Police,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 17-03-2026
CORAM
THE HON'BLE MR.JUSTICE C.KUMARAPPAN Angamuthu @ Gurusamy ..Petitioner Vs The State represented by The Inspector of Police, Kundadam Police Station, Tiruppur District.
Crime No.19 of 2016.
..Respondent PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to grant bail to the petitioner in Cr.No.19 of 2026 on the file of the Respondent Police Station. For Petitioner:
Mr.P.Pugalenthi For Respondents:
Mr.S.Vinoth Kumar Government Advocate (Crl.Side)
ORDER
The petitioner, who was arrested and remanded to judicial custody on 16.01.2026 for the alleged offences punishable under Sections 103(1) of the Bharatiya Nyaya Sanhita, 2023 (302 of Indian Penal Code, 1860) in Crime No.19 of 2026 on the file of the respondent police, seek bail.
2. The case of the prosecution is that the complainant's daughter, namely Poongodi, aged about 25 years, was married to the accused and they were blessed with two children. The accused was employed as a driver in a private bus operating between Coimbatore and Tiruppur. It is alleged that for the past few months, the accused had developed an illicit intimacy with another woman, which resulted in frequent matrimonial disputes between the accused and his wife. While so, on 15.01.2026, the accused is alleged to have taken his wife to the place of occurrence and committed her murder. Hence the case.
3. The learned counsel appearing for the petitioner would submit that the petitioner has no connection whatsoever with the alleged occurrence and that he has been falsely implicated in this case. It is further submitted that the petitioner is an innocent person and he undertakes to abide by any condition that may be imposed by this Court and therefore, he prays to grant bail to the petitioner.
4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that the petitioner was arrested on 16.01.2026 for the grave offence of murdering his own wife. It is further submitted that the investigation is still at a preliminary stage. He would also submit that the petitioner has two previous cases and if he is released on bail at this stage, it would adversely affect the investigation. Hence, he strongly opposed the grant of bail.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.
6. From the submission of the learned counsel on either side, the allegation against the petitioner is one of serious nature involving the offence of murder, more particularly, the murder of his own wife. According to the prosecution, the investigation is in its initial stage. In such circumstances, if the petitioner is enlarged on bail, there is every possibility of the petitioner interfering with the course of investigation or tampering with the witnesses. Further, considering the antecedents of the petitioner, as pointed out by the learned Government Advocate (Crl.Side) and the overall facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 17-03-2026 NSL To
