O R D E R

(The case has been heard through video conference) Heard the learned counsel on either side.

2. The petitioner is in custody since 17.01.2021 for the offences under Section 9-A r/w 23, 25A, 28 and 29 of the NDPS Act.

3. The petitioner was said to have been in possession of 45 Kgs of Ephedrine. It is said to be a controlled substance. It is submitted by the learned Counsel for the petitioner that the rigour of Section 37 of NDPS Act will not apply. The complaint has also been filed. The petitioner is not having any previous case. I am of the view that the continued incarceration of the petitioner will not serve any purpose. Hence, bail is granted to the petitioner. Accordingly, the petitioner is ordered to be released on bail by executing an own bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Principal Special Judge, Principal Special Court under EC & NDPS Act, Chennai.
