This Writ Petition has been filed for a direction to the respondents police to provide police protection in order to enable the Thasildhar, Nallampalli, to measure the lands.
2.Heard the learned Senior Counsel for the petitioner and the learned Additional Public Prosecutor for respondents 1 & 2. 3.On carefully going through the records, it is seen that the 3rd respondent had attempted to claim certain rights over the property and also obtained interim order in his favour. The same was put to challenge by the petitioner before this Court and the CRP was allowed by order dated 30.12.2020 and it was further confirmed by the Hon'ble Apex Court by the order dated 09.02.2021.
4.The petitioner made an application to the Thasildhar, Nallampalli, for measuring and marking the boundaries of the land belonging to the petitioner. The Thasildhar, Nallampalli, on receipt of the application, has requested the police to provide for police protection in order to measure the lands through communications dated 09.03.2024 2/4
and 14.03.2024. Since, the same was not acted upon, the petitioner also made a representation on 15.03.2024 in this regard. The same did not evoke any response and therefore the present Writ Petition has been filed before this Court seeking for appropriate direction. 5.Taking into consideration the facts and circumstances and the materials that have been placed before this Court, there shall be a direction to the 2nd respondent to act upon the communications made by the Thasildhar, Nallampalli, dated 09.03.2024 and 14.03.2024 and provide police protection in order to enable the Thasildhar, Nallampalli, to conduct survey in the subject property.
6.This Writ Petition is disposed of with the above directions. No costs.
