Respondent Prayer : Civil Revision Petition under Article 227 of the Constitution of India to direct the Subordinate Judge, Sathyamangalam to dispose of E.P.No.72/2022 within a time frame to be fixed by this Hon'ble Court. For Petitioner :

O R D E R

This revision seeks for a direction to dispose of E.P.No.72 of 2022 pending on the file of the Subordinate Judge at Sathyamangalam within a stipulated period.

2. O.S.No.9 of 2012 was presented for specific performance of an agreement of sale. The said suit was decreed on 18.01.2017. In order to execute the decree, E.P.No.72 of 2022 was presented. The allegation is that the said proceeding is being dragged on by the judgment debtor seeking time for filing counter for over a period of nearly one year. Hence, this revision.

3. Considering the fact that the parties have been litigating before the Court for over a decade, I am inclined to grant the direction sought for. Accordingly, the learned Subordinate Judge at Sathyamangalam shall dispose of E.P.No.72 of 2022 within a period of six months from the date of receipt of a copy of this order and submit a report to this Court.

4. With the above direction, the civil revision petition is allowed. No costs.
