ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 379 of IPC r/w 21(1) of Mines and Minerals Act (Development & Regulation) Act, 1957, in Crime No.443 of 2020, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found transporting one unit of river sand in an unregistered Bolero van at Swetha river bed. Hence, the law enforcing agency registered a case against the petitioner.

3. The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution. Hence, he sought for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate submitted that the petitioner attempted to transport river sand illegally in a Bolero van. When the vehicle was inspected, one unit of river sand was found. He further submitted that the petitioner has involved in three previous cases similar in nature. Hence, he vehemently opposed for grant of anticipatory bail to the petitioner.

5.In view of the submission made by the learned Government Advocate that the petitioner has involved in three previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
