ORDER
This Criminal Original Petition has been filed seeking a direction to the respondent to complete the investigation in Crime No.321 of 2025 pending on the file of the respondent and file the final report within the stipulate time.

The contention of the petitioner is that he lodged a complaint, pursuant to which, a case in Crime No.321 of 2025 came to be registered on 04.12.2025 against one Rajendran and others. The petitioner had furnished specific allegations and attributed overt act against the accused persons. However, though the names of the accused were disclosed, the same were not properly reflected in the First Information Report, which merely referred to 'Rajendran and others'. He further submitted that despite the disclosure of cognizable offences, no effective investigation has been carried out so far and neither the petitioner nor the witnesses were summoned for enquiry, nor were their statements recorded.

Learned Additional Public Prosecutor appearing for the respondent produced a copy of the RCS Notice and submitted that the case has been closed as 'mistake of fact' and that the final report has been e-filed on 16.03.2026. A scanned reproduction of the said RCS Notice is as follows:

From the materials available on record, it is seen that the police have acted in a highly irregular manner, putting the cart before the horse. While, the First Information Report was registered on 04.12.2025, the RCS notice appears to have been prepared on 03.12.2025, i.e.., prior to the registration of the First Information Report and the petitioner's signature was obtained thereon. The present petition was filed before this Court on 09.03.2026 and upon notice, the learned Additional Public Prosecutor informed the respondent police, pursuant to which, the final report came to be e-filed. 5.
In view of the above, this Court is inclined to set aside the RCS Notice and the consequent final report. The respondent police is directed to forward the entire case diary in Crime No.321 of 2025 to the Deputy Superintendent of Police, Karumathampatti.

The Deputy Superintendent of Police, Karumathampatti, is directed to conduct a fresh investigation and file a final report within a period of three months from the date of the receipt of a copy of this order.
