Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records from the file of the 3rd respondent relating to Na.Ka.B1/2436/2016 dated 24.11.2016 and to quash the same and consequently directing the 3rd respondent to consider the representation made by the petitioner dated 11.04.2018, requesting to replace the proposal of installing the EB Sub Station from the proposed site of S.No.353, Mohameduspuram Village, Anaicut Taluk, Vellore District and the same be installed at Survey No.361-1A, Mohamedupuram Village, Anaikut Taluk, Vellore District or any other any alternative site.

ORDER

When the matter is taken up for hearing today (i.e. 16.11.2021), the learned counsel appearing for the petitioner seeks short accommodation citing the reason that he has misplaced the bundle.

However, the learned Standing Counsel for the respondent-Electricity Board submits that this Writ Petition has been filed to quash the proceedings of the third respondent, dated 24.11.2016, and consequently, for a direction, directing the respondent-Electricity Board not to install the EB Sub Station at the proposed site, viz., at Survey No.353, Mohameduspuram Village, Anaicut Taluk, Vellore District, and to install the same at Survey No.361-1A, Mohameduspuram Village, Anaikut Taluk, Vellore District. Further, the learned Standing Counsel submits that already the EB Sub Station has been installed, and it has been functioning in the proposed site. Therefore, the prayer sought for in this Writ Petition has become infructuous.

3. In view of the above submission, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
