O R D E R
The Petitioner who is apprehending to arrest by the respondent police for the offences punishable under Sections 341, 294(b), 307, 506(ii) of IPC r/w 3(1) of PPD Act, seeks anticipatory bail.
2. The case of the prosecution is that a wordy quarrel arose between the petitioner and the defacto complainant one Venkatesan. At the result of the wordy quarrel, the defacto complainant has lodged the complaint against the petitioner before the respondent. The respondent police registered the case.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he is no way connected with the alleged offence. The respondent police has falsely implicated the petitioner in this case. Hence, he seeks anticipatory bail. 2/5
4. The learned Additional Public Prosecutor has submitted that the petitioner along with other accused persons stopped the private bus and demanded mamool. Due to which a wordy quarrel arose. As a result, the petitioner and other accused persons damaged the screen of the bus, in which the defacto complainant has sustained head injury. Insofar as the petitioner is concerned, three previous cases are registered against him and hence he opposed to grant anticipatory bail.
5. Considering the facts and circumstances of the case and also the previous antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
6. In view of the same, this Criminal Original Petition is dismissed.
