The prayer sought for herein is for directing the respondents to permit the students of 2020-2021 Batch of 2 years B.Ed. Course to appear for the B.Ed. Examinations in July 2021 or on any subsequent dates including the Practical Exams by assigning Registration Number to Students allowing the Petitioner to upload Internal Assessment Marks issuing the Hall Tickets to the Students and to declare the results of the said Students pending disposal of the main Writ Petition.

The petitioner institution has moved this miscellaneous application on the alleged urgent need of getting a direction to permit the institution to upload the Internal Assessment Marks and to issue Hall Tickets to the examination, which is scheduled to be conducted sometime in July 2021 for second year B.Ed Course students of 2020-21 batch of the petitioner institution.

When the case is taken up for hearing as an urgent matter, Mrs.A.V.Bharathi, learned Standing Counsel for the first respondent University, on instructions, would submit that, initially it was proposed to conduct the examination in July 2021, for which the last date was fixed as 27.05.2021 to upload the Internal Assessment Marks of the students of the Institution concerned. However, due to the second wave of COVID-19

pandemic situation, most of the University functions has come to a stand still and it has almost been closed and the University has already decided to defer the examination proposed to be conducted in July 2021, for which last date for uploading of internal marks was fixed as 27.05.2021, which also has been deferred until further orders. Therefore, the learned Standing Counsel would submit that, after the situation improves from the present second wave of the COVID-19 pandemic, the University will take a decision to fix a new date for uploading the Internal Assessment Marks of the students, followed by schedule of examination to be issued thereafter.

4. Therefore, according to the learned Standing Counsel appearing for the University, there is no urgent need for the institution ie., the petitioner herein to upload the Internal Assessment Marks of the students immediately by taking 27.05.2021 as the last date fixed earlier by the University.

5. The said submission made by the learned Standing Counsel for the University is recorded. In view of the said stand taken by the University, since there is no need for the Institution to upload the Internal Assessment Marks immediately on the website of the University for their perusal and further action on or before 27.05.2021, the prayer sought for in this miscellaneous application need not be considered for granting the same.

In that view of the matter, by recording the aforesaid submissions, this miscellaneous petition is disposed of by giving liberty to the petitioner to file appropriate petition at a later point of time in case the University comes forward to fix fresh date for submission of Internal Assessment Marks in their website and also for conducting the examination for second year B.Ed Students of 2020-21 batch.

7. The miscellaneous petition is disposed of accordingly. 07.05.2021 KST
