ORDER

This Criminal Original Petition has been filed to direct the second respondent to conduct reinvestigation in Cr.No.272/2016 and lay final report.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents.

3. The learned Additional Public Prosecutor would submit that the investigation has already been completed as early as on 29.01.2017 and referred charge sheet notice has also sent to the petitioner and filed before the learned Judicial Magistrate, Denkanikottai in R.C.S.No.1 of 2017.

4. The learned counsel appearing for the petitioner would submit that they have not received any referred charge sheet notice from the second respondent.

5. Under these circumstances, reinvestigation cannot be ordered. However, the first respondent has directed to serve referred charge sheet notice along with the closure report to the petitioner within a period of two weeks from the date of receipt of a copy of this order. On receipt of the same, the petitioner is at liberty to approach the concerned Judicial Magistrate, by way of protest petition.

6. This Criminal Original Petition is disposed of accordingly.
