Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, to call for the records on the file of the 2nd respondent made in Proc.No.6790/2007/E2 dated 26.02.2008 and 6790/2007/E2 dated 29.02.2008 and quash both the orders and consequently direct the respondents to permit the petitioner to retire from service on the date of his superannuation i.e., on 29.02.2008 and to disburse all his service benefits and monetary benefits including Gratuity amount with interest at the rate of 12% for delayed payment.

It is submitted by the learned counsel appearing for the petitioner and respondents that subsequent to the filing of this writ petition, the order of suspension made against the petitioner has been withdrawn and he is permitted to retire with all monetary benefits. Under this circumstances, they contend that the matter has become infructuous. The statement of the learned counsels placed on record. 3.

In view of the facts and circumstances of the case, this writ petition is dismissed as infructuous.

Consequently, connected miscellaneous petitions are closed. 5.

There shall be no order as to costs.
