THE HONOURABLE MR. JUSTICE C.SARAVANAN W.P.No. 12197 of 2021 Irfana Javeed ... Petitioner vs
1. The Chairman No.1, Pumping Station Road, Chintadripet, Chennai - 600 002.
2. The Area Engineer - IX, No.5, Muthaiah Street, Royapettah, Chennai - 600 014.
... Respondents Prayer: Writ Petition filed under Article 227 of the Constitution of India praying for the Writ of Mandamus directing the first respondent to dispose of the representation dated 26.09.2019 for provision of water and drainage connection to Diwan Sahib Garden Street, Royapettah, Chennai.
For Petitioner : Mr.L.Damodaran For Respondents : Mr.C.Vigneswaran
ORDER
The petitioner had filed this Writ Petition for a Writ of Mandamus to dispose of the petitioner's representation dated 26.09.2019 for provision of water and drainage connection of Diwan Sahib Garden Street, Royapettah, Chennai. 2.This Writ Petition is opposed by learned counsel for the respondent stating that a similar representation was earlier disposed on 12.11.2014 by the Area Engineer ZoneIV stating that the land for which the petitioner is asking for drainage and water facility belongs to a private land and therefore the water and sewerage connection cannot be given.
3.By way of rejoinder, the learned counsel for the petitioner submitted that there are more than 400 houses in the said location and is situated in the heart of the city in Royapettah, Gopalapuram. It is further submitted that the respondent cannot shrek their responsibility of providing water and sewerage connection in vicinity. 4.I have considered the arguments advanced by the learned counsel for the petitioner and the learned counsel for the respondents and perused the materials available on record.
5.The responsibility is vested with the respondents to provide the water and Sewerage connection. If desired co-operation of other local bodies such as Corporation may be sought for and make sure that the area is provided with required water and sewerage connection . It would be ironical if an area situated in the heart of the city lacks water and sewerage connection.
6.Therefore, I am inclined to dispose of the Writ Petition by directing the respondents to take steps for providing essential amenities to the Petitioner in the form of water and sewerage connection within a period of six months from the date of receipt of a copy of this order in co-ordination with other local bodies such as Chennai Corporation, etc., 7.With the above directions, this Writ Petition is disposed of. No costs. 30.06.2022 gba To
