ORDER
The petitioner, who apprehending arrest for the alleged offence under Sections 8 (c) r/w 20 (b) (ii)(C) and Section 25 of NDPS Act, in Crime No.907 of 2021, on the file of respondent police, seeks anticipatory bail.

The petitioner herein seeks anticipatory bail apprehending arrest by the respondent police in the case related to seizure of 22 kgs of ganja 24/10/2021 from one Karthikeyan.

The case of the prosecution is that, on specific information that the ganja from Andrapradesh procured by one Karthikeyan and sold in and around the Ennore area, by Danasekaran and its associates Ranjith (the petitioner herein) and one Ambeth@Ambedkumar, surveillance was mounted on 24/10/2021 near
Athipet Bridge, Kathivakkam. At about 10.15 a.m., a person who was proceeding in his Honda Activa motorcycle carrying a white colour fertilizer bag was intercepted, since the description given by the informant tallied. On enquiry, the person disclosed his name as Karthikeyan and he procured 22 kgs of ganja from Andrapradesh on the instructions of Ranjith and Ambethkumar and he is proceeding to deliver the same to them. The contraband was seized and Karthikeyan was remanded to judicial custody.

The anticipatory bail petition is strongly opposed by the respondent on the ground that, after the arrest of Karthikeyan with 22 kgs of ganja, the further, investigation has disclosed 6 persons are involved in this case and A-1 to A-4 secured and remanded to judicial custody. Yet another accused arrayed as A-5 was arrested in connection with Crime No.236/2022 on the file of P-1 Pulianthope Police Station for the alleged offences under Sections 341, 294(b), 323, 397, 336 and 506(ii) I.P.C. This petitioner, who is arrayed as A-6 is absconding. On completion of investigation, final report filed before the Special Court for NDPS Act cases.

Contenting that, the petitioner is an History Sheeter (M5 PS/04/HS/R/2014 - A category with 12 criminal cases pending, out of which 2 for murder and one attempt to murder) and close associate of the other accused Dhansekaran, who is A+ category (53 criminal cases pending, out of which 4 for murder and 6 for attempt to murder). This petitioner and Dhansekaran together involved in illegal trading of ganja involving commercial quantity and to ensure their illegal trade used to commit other crimes which are registered against them by various police stations in the State.
6. The counter filed by the respondent police, disclose the role of this petitioner in the crime and his antecedents. Taking into consideration that the contraband seized is of commercial quantity and prima facie material discloses that the ganja seized was transported by Karthikeyan from Andra Pradesh on the abetment of this petitioner. Hence, the petition for anticipatory bail stands dismissed.
