Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Certiorar calling for the records of the 2nd respondent relating to the Charge Memorandum No.A/713/2015 dated 04.05.2015 and to quash the same. ORDER
The petitioner is an Assistant Inspector of Labour. Earlier, she filed a writ petition in W.P.No.10365 of 2015 challenging the order of suspension issued against her. This Court ,by order dated 09.04.2015, disposed of the above said writ petition directing the 1st respondent to complete the disciplinary proceedings arising out of the suspension order dated 20.03.2015 and pass final orders on merits and in accordance with law within a period of two months from the date of receipt of a copy of the order. This court did not interfere with the order of suspension. However, the order of this court has not been complied with and the disciplinary proceeding is not over within two months as directed by this court. While so, a charge memorandum dated 04.05.2015 https://hcservices.ecourts.gov.in/hcservices/
under Rule 17(b) of The Tamil Nadu Civil Service (Discipline and Appeal) Rules was issued to the petitioner by the 2nd respondent. Challenging the above said charge memorandum, the petitioner is, now, before this court with this writ petition.
2. I have heard the submissions made on either side.
3. The learned Additional Government Pleader would, on instructions from the respondents, submit that now an enquiry officer has been appointed and the enquiry would be over and appropriate order would be passed within a period of twelve weeks from today.
4. Recording the said statement made by the learned Additional Government Pleader, this writ petition is disposed of and the 1st respondent is hereby directed to complete the enquiry in the disciplinary proceeding initiated against the petitioner and pass appropriate orders on the same within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected MPs are closed.
