ORDER

Seeking direction to the respondents police to file the final report in crime no.73 of 2018 after completing the investigation, the present petition has been filed by the petitioner.

2.The learned counsel for the petitioner submitted that the petitioner has lodged a complaint before the second respondent police for the alleged offence under section 302 IPC and a case came to be registered in Crime No.73 of 2018 dated 11.04.2018. It is the complaint that the petitioner is residing with her family in a portion of the house which was given by her father. She has rented out one portion and with the money derived from the rental income, she was living her livelihood. The petitioner's brother one Mr.Veerakumar was running an electrical and hardware shop in Pelur Main Road near Ayadyapattinam Ramar Temple. On 10.04.2018 at about 11.00 p.m., after closing the shop, he was sleeping in the shop itself. On 11.04.2018, the petitioner's brother was found murdered and a complaint was lodged before the second respondent police.

It is contended by the learned counsel for the petitioner that since, no action has been taken, a RTI enquiry was made, in which it was informed that since no information or clue was found with regard to the murder and hence, the complaint was dropped on 27.08.2020 as the accused was not traceable. In the report dated 27.08.

examined and suspects were also examined and call details were also verified but no information / clue have been gathered from the same. Hence, the present original petition has been preferred by the petitioner seeking direction to the respondents to proceed further with the investigation and to file the final report. 3.The learned Additional Public Prosecutor appearing for respondents police has filed a status report with regard to this case narrating the sequence of the investigation being conducted. It was stated in the report that the case was under investigation for a prolonged period and was treated as undetected and that a copy of the referred charge notice was also served on the complainant. A report was also placed before the District Munsif-cum-Judicial Magistrate, Valapady.

It is further stated in the status report that now the case has been reopened and investigation is being conducted and all aspects of the case including examining potential enemies of the deceased and gathering intelligence through informants and reviewing the findings of the previous investigating officers are looked into and that the investigation is going in a proper manner. The learned Additional Public Prosecutor submitted that the accused would be identified soon and the investigation will be taken to its logical end.

4.This court heard the submissions made by both sides and perused the status report filed by the respondents police. From the perusal of the status report, it is seen that now the investigation has been reopened and further 3/6

investigation is going on. It is also now submitted by the learned Additional Public Prosecutor that every possible aspects of the case would be examined by the investigating officer and the police would soon identify the accused and file the final report. The status report filed by the respondents police is recorded. In the light of the above, this court is of the view that it is a case of murder and earlier, the complaint was dropped and now the police have reopened the case and investigation is in progress and it is submitted by the learned Additional Public Prosecutor that all necessary steps are being taken to identify the accused and to complete the investigation. In view of the above, the second respondent police is directed to complete the investigation and file the final report without delay preferably within a period of six months from today.
