Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 294(b), 323 and 506(i) of IPC in Crime No.29 of 2021 on the file of the respondent police, seek anticipatory bail.

2. According to the prosecution, the petitioners and the defacto complainant are relatives. The petitioners have taken some materials from the defacto complainant's godown and transferred the same to their godown. When the same was questioned by the defacto complainant, the petitioners entered into quarrel with him and attacked him. Based on the complaint, the respondent police registered a case against the petitioners.

3. The learned counsel for the petitioners submitted that the petitioners have nothing to do with the said allegation and a false case has been foisted on the petitioners. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Public Prosecutor would submit that three accused persons have already arrested and remanded to judicial custody and investigation is still pending. Hence, he opposed to grant bail to the petitioners.

Considering the gravity of the accusation against the petitioners and the case is in the initial stage of the investigation and that the custodial interrogation of the petitioners are essential, this Court is not inclined to grant anticipatory bail to them.
