ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Heard learned counsel for the parties.

2. This Public Interest Litigation (PIL) is completely frivolous, as the allegation that construction of a public auditorium is on pathway is without any material. No revenue records have been placed. The photographs which have been placed on record by the State counsel clearly show that a open space in between the RO plant and the public toilet is being used for construction of the public auditorium. PIL is against the public interest and is not bona fide. The petitioner seems to have some vested interest. Therefore, the petition has to be dismissed.

3. Accordingly, the petition is dismissed with costs quantified at Rs.10,000/- (Rupees Ten Thousand only) payable to the Tamil Nadu State Legal Services Authority within one month. Consequently, connected miscellaneous petition is closed.
