ORDER
The petitioner, as complainant, has filed a complaint under Section 138 of the Negotiable Instruments Act against the second respondent/accused. The
accused have been adopting dilatory tactics and protracting the trial by frequently absenting himself, thereby necessitating issuance of a Non-Bailable Warrant, which is pending execution. Hence, the petitioner has filed the present petition seeking a direction from this Court to complete the trial within a stipulated time frame.
2. The learned Government Advocate (Criminal Side) submits that the accused was arrested and brought to the police station, and on 24.03.2026 executed a bond.
3. The learned counsel for the petitioner submits that, notwithstanding execution of the bond, the accused has failed to appear before the trial court in CC.No.133 of 2024, resulting in repeated adjournments. On 10.06.2026, neither the accused nor his counsel appeared, and the matter remains pending for execution of Non-Bailable Warrant. Since 01.04.2025, the case is adjourned for service pending warrant and it now stands posted to 27.06.2026.
4. Accordingly, the inspector of Police, J-7 Velacherry Police Station, is directed to execute the Non-Bailable Warrant and secure the presence of the accused before the trial court on 27.06.2026 in C.C.No.133 of 2024. On his appearance, the Trial Court to take expeditious steps to complete the trial,
preferably within a period of three months from the date of receipt of a copy of this Order.
5. With the above directions, this Criminal Original Petition is disposed of.
