ORDER
The petitioner, who was arrested and remanded to judicial custody on 14.12.2025 for the alleged offences under Section 8(c), 22(c) and 29(1) of
NDPS Act, 1985 in Cr. No.284 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that on 14.12.2025, A1 to A5 were travelling jointly together and A1 was found in illegal possession of 56 grams of Methampetamine and A2 was under illegal possession of 8 MDM tablets and hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is A5 and he has been under incarceration since 14.12.2025. He would further submit that there are about 9 accused and there is no recovery from this petitioner and hence prayed to enlarge the petitioner on bail.

At this juncture, the learned Government Advocate (Criminal side) appearing for the respondent police would submit that though there is no recovery from this petitioner, A1 to A5 were secured at the same place and recovery was effected simultaneously and apart from that, investigation is at preliminary stage. Therefore, he strongly objected the bail application.
5. I have given anxious consideration to the submissions made by the learned counsel on either side.

It is the specific submission of the learned Government Advocate that from A1, 56 grams of Methampetamine was recovered, which is a commercial quantity and the rigors under Section 37 of NDPS Act would attract. Considering the totality of circumstances, upon the fact that the investigation is still pending, upon the fact that the contraband recovered from A1 is 56 grams of Methampetamine, which is a commercial quantity and this Court could not find any material to overcome rigors under Section 37 of NDPS Act and it is a premature stage to consider the bail application and therefore, this Court is not inclined to enlarge the petitioner on bail at present.
7. Accordingly, this Criminal Original Petition is dismissed. 08-04-2026 MJS Note:
