Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent herein to pass orders on the petitioner representation dated 13.08.2014 within a time frame prescribed by this Hon'ble Court.

The petitioner seeks for a Mandamus, directing the respondents to pass orders on her representation dated 13.08.2014, wherein and whereby, she seeks for sanctioning pension and other monetary benefits, payable to her husband by name Deenadayalan, who was working as LUSCAR in the Government Stanley Medical College & Hospital.

2. It is stated that the petitioner is the wife of the said Deenadayalan. It is further stated that the said person also married the second respondent, subsequently, with the consent of the petitioner. The said Deenadayalan died on 29.04.2005, leaving behind the petitioner and three children as his legal heirs. However, the first respondent is not disbursing the pension and other benefits payable in pursuant to the death of her deceased husband, in spite of the request made by the https://hcservices.ecourts.gov.in/hcservices/

petitioner along with the second respondent on 13.08.2014. Therefore, the present writ petition is filed seeking for disposal of the said writ petition.

3. The learned counsel for the second respondent submitted that the second respondent is not having any objection in disbursing the pension benefits to the petitioner.

4. When such being the factual position, I do not think that there will be any impediment for the first respondent to consider the request of the petitioner and pass appropriate orders for grant of pensionary benefits. Accordingly, this Writ Petition is disposed of, only by directing the first respondent to consider the claim of the petitioner dated 13.08.2014 and pass orders on the same on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs.
