O R D E R

The petitioner joined as a Conductor in the respondent Corporation in the year 1979 and he retired as the Senior Checking Inspector on 30.01.2015, on attaining the age of superannuation. 2.The grievance of the petitioner is that, he is not paid gratuity, earned leave encashment benefit and IRT Share. He was paid only Provident Fund amount and also monthly pension of Rs.14,181/-.

3.As per the Payment of Gratuity Act, gratuity should have been paid immediately on the retirement employee. Hence, I am inclined to issue a direction to the respondent to settle the gratuity, earned leave encashment benefit and IRT share to the petitioner immediately.

4.In the result, the writ petition is disposed of with a direction to the respondent to settle the gratuity, earned leave https://hcservices.ecourts.gov.in/hcservices/

encashment benefit and IRT share to the petitioner, as per the law, within a period of six weeks from the date of receipt of a copy of this order. No costs.
