ORDER : The Court Made the following order :- The petitioners, seek Anticipatory bail for the alleged offence under Section 147, 294(b), 120(b), 506(i) IPC & 3(1) of TN PPD & L Act in Crime No.349 of 2017.
2. Heard both sides.
3. The case of the prosecution is that the petitioners and the defacto complainant known to each other and following a quarrel, the petitioners damaged a portion of defacto complainant's motorcycle and the damage was assessed at Rs.2,000/-.
4. The learned counsel for the petitioner would submit that without prejudice to their defence, the petitioners are ready to deposit Rs.2,000/- and he prayed for anticipatory bail.
5. The learned Government Advocate (Crl. Side) submitted that the damage was assessed at Rs.2,000/-.
6. Having regard to the nature of allegations against the
petitioners and taking into account that the petitioners volunteered to deposit the amount, and the petitioners have no bad antecedent and it is not stated that petitioners custodial interrogation is necessary, I am inclined to grant anticipatory bail to the petitioner's, subject to the following conditions. 7 (i) Petitioners are ordered to be released on bail in the event of their arrest or appearance before the learned Judicial Magistrate-II, Mayiladuthurai, within a period of fifteen days days from the date of receipt of a copy of this order on each of them executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate.
(ii) The petitioners shall deposit Rs.500/- each (totally Rs.2,000/-) to the credit of Crime No.349 of 2017 before the said Court, within a period of two weeks, from the date of receipt of a copy of this order, before executing the bond. (iii) The final order in respect of the said deposit shall be passed by the Trial Judge at conclusion of trial. (iv) Petitioners shall report before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation.
