Respondent in CRP (PD) 4132 of 2009/Plaintiff & Defendants 1 to 3 TERMS OF SETTLEMENT The Revision Petitions are as against in I.A.No.658 of 2011 IA 405/08 and I.A.406/08 which was filed for impleading the defendants 4 and 5 in the suit and also to set aside the exparte order passed against them on 30.06.2011. The original suit is filed by the bank for recovery of money due in respect of the loan transaction between the plaintiff's bank and the defendants 1 to 3.
Now, the bank itself made an endorsement that the entire matter has been settled by way of one time settlement and the counsel had also made an endorsement that no further claim against the bank in respect of the transaction can arise. Subsequently, the counsel for Civil Revision Petitioner appears and reports that matter was settled before the regular court. In view of the endorsement, the Civil Revision Petitions has become infructuous as suit has been settled in full by the plaintiff between the parties. Consequently, the Civil Revision Petitions are closed. Consequently, connected Miscellaneous Petition is also closed.
This Lok Adalat award is passed in terms of the above settlement.
The Court fee paid shall be refunded to the parties in the
manner provided under the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
