The petitioner, who was arrested and remanded to judicial custody on 22.05.2016 for the alleged offences punishable under Sections 294(b), 323, 397 and 506(ii) IPC in Crime No.187 of 2016 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner is alleged to have robbed a sum of Rs.500/- at knife point from the defacto complainant.
3. Learned Government Advocate (Crl.
Side) submitted that the petitioner is involved in two previous cases, out of which one case is under section 302 IPC and another case under section 307 IPC.
4. Learned counsel for the petitioner submitted that the petitioner has not committed any such offence and a false case has been foisted against him. He further submitted that the case under section 302 IPC has been ended in acquittal and the case under 307 is pending at the stage of trial.
5. Even though, the case under section 302 IPC has ended in acquittal, as the case under section 307 is pending, taking note of the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner and the petition is dismissed. vrc 22.07.2016
