Prayer: Writ Petition is filed under Article 226 of the Constitution of india praying for issuance of Mandamus directing the respondents 1 to 3 to issue legal heir certificate by including petitioner name as well as all other legal heirs of the petitioner deceased father Paul Raj by Considering the representation dated 02.02.2024, 05.08.2024, 16.12.2024, within a time frame fixed by this Honble court.

Mr.M.Rajendran, Additional Government Pleader for R1 to R3 Order The present writ petition has been filed for a direction to be issued to the respondents 1 to 3 to issue legal heir certificate by including petitioner's name and all other legal heirs of the petitioner deceased father Paul Raj by considering his series of representations.

2. Case of the petitioner is that his father out of his first wed lock, begotten three respondents 4 to 6 herein and after the demise of his first wife, he married to the petitioner's mothers. Out of the said wedlock, they begotten 3 children viz., the petitioner along with his two sibling. The petitioner's father was died on 21.07.2015 leaving behind the petitioner, his siblings and his step brothers as his legal heirs to succeed his estate and thereby the petitioner along with other legal heirs inherited his property and in joint possession and

enjoyment. While so, the 4th respondent and his siblings made application for legal heirship and obtained the same by suppressing the existence of other legal heirs so as to grab the property of the petitioner's father. Hence, the petitioner made representation dated 16.12.2024 to include the names of all the legal heirs in the legal heir certificate, in which the 3rd respondent conducted enquiry and asked the petitioner to appear and submit necessary documents on 28.03.2025. The petitioner also appeared and submitted all the necessary documents. Despite the petitioner's complaint and submission of documents, in support of his claim and repeated request to issue legal heir certificate to include all the legal heirs and to cancel the fraudulent legal heir certificate obtained by the 4th respondent, no action has been taken so far in the said enquiry. Hence the petitioner is before this Court.

The learned counsel appearing for the petitioners would submit that it would suffice, if the first respondent is directed to dispose of the enquiry conducted by the 3rd respondent based on the representation of the petitioner dated 16.12.2024 on merits and in accordance with law, within a specified period.

4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.

5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents.

6. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the third respondent to conclude the enquiry after providing opportunity to all the necessary parties, based on the representation of the petitioner dated 16.12.2024 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order and issue legal heir certificate to the eligible persons within a further period of four weeks thereafter.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
