Captioned 'Civil Miscellaneous Petition' (hereinafter 'CMP' for the sake of brevity) has been filed with a prayer for extension of time to make deposit of the entire award amount as awarded by the 'Motor Accidents Claims Tribunal' (hereinafter 'MACT' for the sake of brevity).
2. The order made by Hon'ble Predecessor Bench being order dated 08.03.2024 reads as follows:
'CMA No.290 of 2024 and CMP No.3239 of 2024 R.SUBRAMANIAN, J.
and R.SAKTHIVEL, J.
Mr.M.R.Jothimanian, learned counsel takes notice for the 1st respondent and Mr.Meenakshisundaram, learned counsel takes notice for the 2nd respondent. 2.There will be an order of interim stay of execution of the award on condition the petitioner deposits the entire award amount by 25.03.2024. 3.Post on 26.03.2024 under the "adjourned
admission" caption.'
3. Hon'ble Predecessor Bench vide order dated 26.03.2024, extended time upto 23.04.2024 on the assurance given by learned Additional Advocate General that entire compensation amount will be deposited within a period of four weeks and directed the matter to be listed on 24.04.2024. Thereafter, the matter came up for hearing today (i.e., 30.04.2024).
4. Mr.Ramanlal, learned Additional Advocate General for petitioner, Mr.M.R.Jothimanian, learned counsel for first respondent and Mr.Meenakshi Sundaram, learned counsel for second respondent are before this Court.
5. Mr.Ramanlal submits that an executive order being G.O.(D) No.505 Home (Police - XI) Department dated 22.04.2024 has been issued and the entire award amount could not be deposited within the time granted owing to procedural delay but learned Additional Advocate General submits that in the light of the executive order, the deposit will now be made within ten days from today i.e., by 10.05.2024. The claimant has also agreed for this course and requests for extension of time for the same. Owing to this undertaking that the deposit will be made within ten days from
today, the prayer for extension of time qua 08.03.2024
order (further extension granted vide 26.03.2024 order), is acceded to albeit with a caveat that deposit as per 08.03.2024 order shall now be made on or before 10.05.2024.
6. Captioned CMP is ordered as prayed for albeit with the aforementioned observation.
