O R D E R
The petitioner, who apprehends arrest for the alleged offence under Sections 296(b), 115(2), 118(1), 351(3) of BNS, in Crime No.6 of 2026, on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner along with 1/4
other accused attacked the defacto complainant with deadly weapon and thereby caused severe injury. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any such offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and ready to co-operate with the investigation and that co-accused have already been enlarged on bail by this Court and that on the ground of parity he prays to grant anticipatory bail to the petitioner.. Hence, he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, would strongly oppose the anticipatory bail application of the petitioner on the ground that though the other accused have been released on bail they were enlarged after investigation and that in the present case, for mere asking of the address proof with the petitioner, the defacto complainant was beaten black and blue due to which, the defacto complainant was compelled to take treatment for nearly one month from 04.01.2025 to 01.02.2025. 2/4
5. Heard the submissions made by the learned counsel on either side and also perused the materials available on record.

In such view of the grave allegation against the petitioner, this Court is of the firm view that if the petitioner is enlarged on anticipatory bail in such type of grave offence, it would give wrong signal to the society and people may be emboldened to indulge in such activities and hence the petitioner does not deserve anticipatory bail.
7. Accordingly, this Criminal Original Petition is dismissed. 13.03.2026 ssi To:
