The applicant has filed the above application seeking for a direction to the learned AG & OT to give on lease the property bearing Door No.10, Mohandas Lane, Border Thottam, Chennai, for a period of 33 years on monthly rent of Rs.3,600/- subject to any reasonable revision once in every three years.

2.It is the case of the applicant that he is a Doctor by profession and doing charity and for the said purpose, he required the property in question on lease for a period of 33 years. The learned AG & OT filed a counter, wherein, it has been stated that, it is a practice of AG & OT that, in case of letting out the property on lease is only by way of public auction. Further, the learned AG & OT has stated that, if the applicant is interested in purchasing the petition mentioned property on lease, he can participate in the public auction and take the property on monthly rent. https://www.mhc.tn.gov.in/judis

A.No.1902 of 2021 M. DURAISWAMY , J.

mkn 3.When the properties which are under the control of the learned AG & OT are leased out by conducting public auction, no indulgence can be shown to the applicant for extending the lease without conducting public auction, as rightly stated in the counter. If the applicant is interested in taking the property on lease, he can participate in the public auction. In such view of the matter, I am not inclined to grant the relief sought for in the application.

4.Accordingly, the application is dismissed.
