Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st respondent to provide adequate police protection for ingress and egress of vehicles and movement of people from in and out of the registered office, vehicle parking of the petitioner and further prevent trespass of members of 2nd respondent 1/5

Union by ensuring that no demonstration, assemble illegally in any form within a radius of 500 meters from petitioners Registered office premises namely Damper Technology India Pvt. Ltd., S.F. No. 596/1,2,3. Palakkad Main Road, K.G. Chavadi, Coimbatore 641 105 and pass such further or other orders as this Honble court may deem fit, pursuant to the complaint of the petitioner dated 20.03.2024 and email dated 25.03.2024. O R D E R

This writ petition has been filed for a direction to the 1st respondent to provide adequate police protection for ingress and egress of vehicles and movement of people from in and out of the registered office 2.

The learned counsel for the petitioner submitted that the workers have been squatting near the factory premises from 16.03.2024 onwards inspite of conciliation proceedings pending before the competent authority. Therefore, the representation was given to the police to provide 2/5

protection and to ensure free ingress and egress to the premises. 3.

The learned Additional Public Prosecutor on instructions submitted that the strike itself has been called of yesterday. 4.

Recording the submission of the learned Additional Public Prosecutor, if at a future date, any attempt is made to disrupt the free ingress and egress into the factory premises by the disgruntled workmen, the representation made by the petitioner seeking for police protection shall be entertained by the 1st respondent and the 1st respondent shall ensure free ingress and egress of men and material from and to the factory premises. If any demonstration or strike is sought to be conducted by the workmen, it shall be done in a place away from the factory premises and it shall be ensured that it does not affect the free ingress and egress to the factory premises.

This writ petition is disposed of in the above terms. No costs. 3/5
