Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to consider and pass orders on the petitioner's representation dated 08.02.2024 for deleting the wrongful entry of classification of his land mentioned as "Government Poromboke" lands instead of "Grama Natham" in the guideline value register maintained by the 5th respondent office in respect of his property comprised in Survey No.33/2 bearing patta No.208 measuring about 2392 sq.ft situate at Anaivari Village Bhuvanagiri Taluk For Petitioner :

ORDER

This Writ Petition has been filed seeking for a direction to the respondents 1 to 3 to consider and pass orders on the petitioner's representation dated 08.02.2024 for deleting the wrongful entry of classification of the land as "Government Poromboke" instead of "Grama Natham" in the guideline value register maintained by the 5th respondent office.

2.It is the case of the petitioner that the subject property is the ancestral property of the petitioner and classified as "Grama Natham". In fact, the Partition Deed has been registered in 2005 as Document No.1333/2005 in the office of the 5th respondent and Patta No.208 has been issued in favour of the petitioner. In the guideline value Register, the said S.No.33/2 has been shown as Government Poromboke and in the "A" Register also, the same has been reflected. Hence, this Writ Petition has been filed to consider the representation of the petitioner. 3/6

3.I have carefully considered the arguments on either side. When the property has already been partitioned in the year 2005 the same has been registered as Document No.1333/2005 in the office of the 5th respondent. Thereafter, it appears that patta has been issued in favour of the petitioner in Patta No.208 in S.F.No.33/2 treating as "Grama Natham". The said communication is also addressed to the 4th respondent by the Registration Department. Now the respondents shall pass an order based on the registered documents and also patta issued in the name of the petitioner and rectify the mistake in the concerned Register, within a period of two weeks from the date of receipt of a copy of this order. Accordingly, this Writ Petition is disposed of. No costs. 08.04.2024 Index : Yes / No Internet : Yes / No mps 4/6
