ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 296(b), 132, 351(3) of BNS, in Crime No.660 of 2025, on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that he was involved in the illegal transportation of 1/4 unit of river sand in a bullock cart without any valid permission. Hence, the case.

3. The learned counsel for the petitioner submitted that this is the third anticipatory bail petition and that the earlier petitioners were dismissed on the ground that the petitioner has five previous cases. He further submitted that the petitioner is ready to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has five previous cases pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submission of the learned counsel on either side, this Court is of the view that the petitioner has five previous cases, which clearly demonstrates that the petitioner has misused the liberty granted by this Court

and subverts the course of justice by repeatedly committing the similar offences. Further the present case involves the illegal exploitation of natural resources, which has to be viewed seriously. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
