This Court, by order dated 29.03.2019, permitted the Adhoc Committee and Federation to send U-14 Players for Tamil Nadu for the Mini Volleyball Tournament for U-14.

In that circumstances, today, when the case is taken up for hearing, the learned counsel appearing for the applicant submitted that, though an order has been passed as stated above on 29.03.2019, if the respondent i.e., Adhoc Committee alone is permitted to complete the selection process of U-14 Players team to be sent on behalf of Tamil Nadu to participate in the forthcoming Tournament, there will be a room for biased selection. He would further submit that, moreover, the Selection has to be made from among all the eligible players throughout Tamil Nadu and in this context, according to his instructions, number of Districts have not been communicated or not going to represent by sending their eligible players, U-14, to the respondent in the selection process which includes a trial run, which will go for a day or two. Therefore, the learned counsel for the applicant submitted that, if an independent observer is appointed in this regard, under whose supervision, the selection process, which includes the trial run, can go on.

In response to the said submission made by the learned counsel for the applicant, the learned counsel for the respondent i.e., Adhoc Committee and Federation submitted that, instead of appointing an independent observer, who may not be well versed with the selection process, experts from both sides can be permitted to participate in the selection process so that, the chance of alleged bias as apprehended by the petitioner can be avoided.

In this context, the learned counsel for both sides suggested that, each side can sponsor two of its members or nominees, who are experts in the field and they would constitute a temporary Committee of Selection, who can finalise the selection process by overseeing the trial run conducted in this regard. They also suggested that, all eligible players from all Districts of Tamil Nadu can enroll on or before the date to be indicated in this regard and in such case, all such eligible players U-14, who have enrolled, would be taken into consideration for the selection process.

5. In this regard, the learned counsel for the petitioner has suggested the two names to be nominated on their behalf, like that, the learned counsel for the respondent Adhoc Committee has suggested the two nominees to be nominated on their behalf.

6. The following two members are to be nominated by the petitioner:

1) Mr.A.Kannan, Indian School Team Coach - Secretary-in-charge, Nagapattinam District Volleyball Association.

2) Mr.K.T.Lakshmi Narayanan - Level 2 Coach, Federation of International Volleyball - Joint Secretary, Thiruvallur District, Volleyball Association.

7. The following two members shall be the nominee of the respondent/Adhoc Committee:

1) Mr.Raja, Secretary, Namakkal District, Volleyball Association.

2) Mr.Chandrasekhar, Secretary, Madurai District Volleyball Association.

I have considered the said submissions made by the learned counsel for both sides and having taken into account the aforementioned situation and in order to ensure the un-biased selection process of eligible players U-14 for participating in the 27th Mini Volleyball Championship which would be conducted from 24.04.2019 to 26.04.2019, the following order is passed in continuation of the order dated 29.03.2019 referred to above:

(i) That the following four members, i.e., Mr.A.Kannan, Mr.K.T.Lakshmi Narayanan, Mr.Raja and Mr.Chandrasekhar, shall constitute a Temporary Selection Committee for selecting the players U-14 for the Tournament called "27th National Volleyball Championship, for boys and girls", to be held between 21.04.2019 and 26.04.2019 or any other subsequent date or dates. (ii) The Temporary Selection committee shall ensure that, all the eligible players from all the Districts of Tamil Nadu as forwarded/recommended/registered through the respective District Bodies are permitted to take part in the selection process [trial run].

Accordingly, the final selection of the players for the team for both boys and girls to be made by the Selection Committee and such final selection list shall be finalised by the Selection Committee consisting of aforesaid four members. Final selection list shall be displayed in the Notice Board of the Association/Federation. This order is issued as a modified order to the earlier order dated 29.03.2019 passed in these applications. 04.04.2019 Note : Issue copy on 05.04.
