This original petition has been filed taking advantage of Section 372 of the Indian Succession Act, seeking Succession Certificate with respect to the husband of the 1st petitioner and the father of the 2nd to 4th petitioners, Jayantilal M.Jain, who died on 08.01.2020. At the time of his death, he had shares in the name of the company, which had been stated in the schedule to the petition.

2.Paper publication had been effected. The 1st petitioner was examined as PW-1. The death certificate of her husband, Jayantilal M.Jain, was marked as Ex.P1 and the death certificate of his mother Sati Devi was marked as Ex.P3. The legal heirship certificate of Jayantilal M. Jain was marked as Ex.P2. The statement relating to share holding was marked as Ex.P4. The consent affidavits given by the 2nd to 4th petitioners were marked as Exs.P5 to P7. The copy of the paper publication was marked as Ex.P8. 3.In view of the evidence adduced, this Original Petition stands allowed. The Succession Certificate may be issued in the name of the 1st petitioner, Mangi Devi.
