ORDER
This Writ petition has been filed for issuance of a Writ of Certiorari to call for the entire records relating to the impugned Japthi Notice in Form-7 dated 05.08.2025 (in CEP No.4/2010-2011 surcharge order No.Na.Ka. No.194/ 2011 / Sapa dated 15.06.2012) issued by the 2nd respondent and the Auction Notice issued by the 1st respondent in Form Nos.8 and 9 dated 23.02.2026 in (CEP No.4/210-2011-(Na.Ka. No.194/2011/ Sapa) Surcharge order No.Na.Ka. No.194/ 2011 / Sapa dated 15.06.2012) and quash the same.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the respondents 1 and 2 and the learned Special Government Pleader appearing for the 3rd respondent and perused the documents placed on record.
3. According to the petitioner, the petitioner was appointed as a Salesman in the I.I.538 East Maruthar Primary Agricultural Coop. Credit Society on 04.01.1988, later, he was promoted to various designations, finally, he was promoted as a Senior Clerk. In the meantime, the petitioner was posted to the 3rd respondent society, on deputation on 28.02.2010, as per direction given by the higher officials. The petitioner joined in the said society on 26.05.2010 and was suspended on the same day, due to misappropriation of the 3rd respondent-society. Later, the enquiry officer was appointed and in the said enquiry, it revealed that the petitioner has not committed any misappropriation in the 3rd respondent-society, therefore, his suspension was revoked and the petitioner was reinstated into service on 13.03.2012.
Thereafter, the petitioner was working as a senior clerk and allowed to retire from service, on superannuation, on 28.06.2018 and the petitioner retired from service on 30.06.2018. However, without considering the real aspects, the 2nd respondent herein wrongly issued a Japthi Notice, challenging the same, the present Writ Petition has been filed.
4. The learned Government Advocate appearing for the respondents 1 and 2 and the learned Special Government Pleader appearing for the 3rd respondent would submit that auction notice has already been withdrawn, therefore, nothing survives for further adjudication and no further orders are
necessary in this Writ Petition, thereby pleaded to close the present Writ Petition.
Considering the above said facts and circumstances of the case and taking note of the submission of the learned counsel appearing for the respondents that the auction notice has already withdrawn by the respondents, the present Writ Petition is closed, as nothing survives for adjudication. Consequently, W.M.P.No.10895 of 2026 filed to dispense with the production of the original impugned Japthi Notice in Form-7 dated 05.08.2025, is ordered as prayed for and W.M.P.no.10896 of 2026 is also closed. No costs.
