ORDER

This writ petition has been filed challenging the impugned proceedings of the 4th respondent, dated 23.02.2026, putting the petitioner on notice about the proposed survey and demarcation of boundaries made at the instance of the 5th respondent and pursuant to the orders passed by this Court in W.P.No.756 of 2026 dated 20.01.2026.

2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4. Since no adverse order is passed against the 5th respondent in this writ petition, notice to the 5th respondent is dispensed with by this Court.

3. The petitioner has raised objections through his representation dated 09.02.2026 with regard to the proposed survey to be conducted at Page No.2 of 6

the instance of the 5th respondent. The petitioner also claims that a civil suit is also pending between the parties, namely the petitioner and the 5th respondent and others.

4. Necessarily, the objections raised by the petitioner will have to be considered by the 4th respondent before proceeding to survey and demarcate the boundaries of the property on the basis of the request made by the 5th respondent and as per the directions of this Court on 20.01.2026 in W.P.No.756 of 2026 filed by the 5th respondent. In fact, the order dated 20.01.2026 passed by this Court in W.P.No.756 of 2026, the interest of the petitioner has been fully protected by directing the Tahsildar to issue notice to all the necessary parties before conducting survey and demarcation of boundaries.

The apprehension of the petitioner is that despite the objections raised by him, the 4th respondent, without considering those objections, is proceeding with the survey and demarcation of boundaries. Necessarily, the objections of the petitioner has to be considered by the 4th respondent and only thereafter, the 4th respondent shall proceed with the survey and demarcation of the boundaries made at the instance of the 5th respondent. For the foregoing reasons, this Writ Petition is disposed of by directing the petitioner to participate in the impugned proceedings by submitting his objections in writting with regard to the survey and demarcation of boundaries and the 4th respondent shall consider the said objections on merits and in accordance with law and only thereafter, the survey and demarcation of boundaries of the property as prayed for by the 5th respondent in his application can be done. No costs. Consequently, the connected miscellaneous petition is closed.
