ORDER
The petitioner apprehends arrest for the alleged offence under Sections
303(2) of BNS, Act in Crime No.379 of 2025 on the file of the respondent police seeks anticipatory bail.
2. The allegation against the petitioner is that the petitioner illegally transported 4 units of gravel sand in a tipper lorry bearing Registration No. KA 08 5948 without any valid permission. Hence, the complaint.
3. Learned counsel for the petitioner submitted that this is the third anticipatory bail petition filed by the petitioner. He further submitted that he is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that the petitioner has two previous cases, similar in nature pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.
5. In such view of the matter, the petitioner has two previous cases of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
