O R D E R
This Writ Petition has been filed to direct the 2nd respondent to dispose of the petitioner's application dated 10.01.2026 filed under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, within a time frame to be fixed by this Court.
2.The 3rd respondent is the son, 4th respondent is the daughter-in-law and 5th and 6th respondents are the grand children of the petitioner. According to the petitioner, he had executed a settlement deed in favour of his grand children namely the respondents 5 and 6 on the assurance given by his sons' family that they will take care of him. According to the petitioner, despite the said assurance, the respondents 3 to 6 have disowned him and they have committed an act of cruelty. Therefore, the petitioner filed an application under Maintenance and Welfare of Parents and Senior Citizens Act, 2007 on
10.01.2026, seeking to cancel the settlement deed executed in favour of the grand children and for seeking protection for himself. Since no action was taken by the respondents, now the petitioner seeks for early disposal of the petitioner's application dated 10.01.2026 by the 2nd respondent. 3.No prejudice will be caused to the respondents if the petitioner's application is directed to be disposed of by the 2nd respondent on merits and in accordance with law, after hearing the objections of the respondents 3 to 6 and by adhering to the Principles of natural justice, within a time frame to be fixed by this Court. This Court is not expressing any opinion on the merits of the petitioner's application.
4.Since no adverse orders are passed as against the respondents 3 to 6, notice to the respondents 3 to 6 is dispensed with by this Court in this Writ Petition.
5.For the foregoing reasons, this Writ Petition is disposed of by directing the 2nd respondent to pass final orders on merits and in accordance with law on the petitioner's application dated 10.01.2026, filed under the provisions of the Maintenance and Welfare of parents and Senior Citizens Act, 2007, after
hearing the objections of the respondents 3 to 6 and by holding appropriate enquiry and by adhering to the Principles of natural justice, within a period of twelve weeks from the date of receipt of a copy of this order. However, there shall be no order as to costs.
