Contempt filed under Section 11 of the Contempt of Courts Act to issue summon and punish the respondent for his act of contempt of court for deliberately disobeyed the order passed in Crl.OP.No.15047 of 2020 dated 24.09.2020 by this Court.

ORDER

This contempt petition has been filed to punish the respondent for non complying the order passed by this Court dated 24.09.2020 in Crl.OP.No.15047 of 2020, thereby directed the respondent to complete the 1/4

investigation and file final report within a period of twelve weeks from the date of receipt of copy of the order in Cr.No.552 of 2019. 2.

The learned Additional Public Prosecutor submitted that as directed by this Court, the respondent completed investigation and found that no charge has been made out and closed as mistake of fact by the closure report dated 14.06.2021. The same was filed before the concerned jurisdictional Magistrate. In fact, referred charge sheet notice was also duly sent to the petitioner / defacto complainant on 12.06.2021. 3.

Considering the above submissions made by the learned Additional Public Prosecutor, no contempt is made out as against the respondent. Accordingly, this contempt petition is dismissed. However, the petitioner is at liberty to file protest petition on the closure report before the jurisdictional Magistrate in the manner known to law, if so advised.
