PRAYER: The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the Registrar of Cooperative Societies / 1st respondent herein to adjudicate and dispose of petitioner Dispute Petition dated 13.02.2026 filed before him u/S 90 of the Tamil Nadu Cooperative Societies Act, 1983, against the order No.Na.Ka. 1229/ 2024 PACS dated 11.06.2024 passed by the 2nd respondent herein, in the circumstances of the case, within a time framed to be fixed by this Court. ORDER
The present Writ Petition has been filed seeking issuance of a Writ o Mandamus directing the Registrar of Cooperative Societies / 1st respondent to adjudicate and dispose of the petitioner's Dispute Petition dated 13.02.2026 filed before him under Section 90 of the Tamil Nadu Cooperative Societies Act, 1983, challenging the order No.Na.Ka.1229/2024 PACS dated 11.06.2024 passed by the 2nd respondent.
2. The learned counsel for the petitioner submitted that the petitioner is a member of the Bhavani Kuruchi Primary Agricultural Co-operative Society.
Although the Society was intended for Bhavani Kuruchi Village, the building was constructed at Sembadampalayam Village. Aggrieved by the same, the petitioner filed a Writ Petition in W.P.No.26014 of 2024. While that petition was dismissed on 11.06.2024, the said order was confirmed by the Division Bench of this Court in W.A.No.3179 of 024. In its judgment, the Division Bench of this Court granted liberty to the petitioner to raise a dispute under Section 90 of the Tamil Nadu Cooperative Societies Act, 1983, before the 1st respondent. Consequently, the petitioner raised the dispute; however, no orders have been passed till date. Challenging the same, the present Writ Petition has been filed.
3. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents.
4. Considering the facts and circumstances of the case and the submission made by both parties, this Court directs the 1st respondent to consider the petitioner's Dispute Petition dated 13.02.2026 and pass appropriate orders on merits, and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
