ORDER
(1) The present writ petition is filed seeking a mandamus, to direct the respondents to grant notional promotion to the petitioner as Assistant Accounts Officer from the post of Accounts Supervisor w.e.f.11.02.2011 on par with her juniors, by extending benefits of Board proceedings vide (per) CMD TANGEDCO proceedings no.59/(Adm.Branch) dated 24.05.2013 with all monetary and consequential benefits and consequential revise the scale of pay in the post of Assistant Accounts Officer notionally w.e.f.11.02.2011 and revise the pensionary and terminal benefits and pay the arrears of difference amount to the petitioner, by considering the representation of the petitioner dated 06.03.2025 in the light of the order passed in W.P.No.4059/2014 dated 13.12.2022.
(2) Mr.R.Nikkhilesh Athav, learned counsel accepts notice on behalf of the respondents. With the consent of the learned counsels on either side, the writ petition is taken up for final disposal at the admission stage itself.
(3) The petitioner joined the services of the respondent Board as Typist on 12.06.1981. On acquiring various qualifications, both academic and technical and also passing the Departmental Tests, the petitioner was selected for promotion as Accounts Supervisor and her seniority was fixed at Seniority No.1357 in Sl.No.316A and she joined the Central Office at Tanjavur, as Accounts Supervisor. The petitioner states that the 2nd respondent, vide letter dated 28.08.2010, prepared a fresh panel for the post of Assistant Accounts Officer, for the year 2010-2011 and the petitioner's name was placed at Sl.No.15 with Seniority No.1357. To her shock and dismay, the petitioner found that some of her juniors were included in the panel above her and were promoted as Assistant Accounts Officers with effect from 08.02.2011 vide BP.No.7, dated 08.02.2011.
On enquiry, the petitioner was informed that her name was deferred on the ground that she did not pass SSLC/PUC/12th standard, though she had obtained B.Com, and M.Com degrees through Open University. The petitioner, after rendering unblemished service of 30 years, retired from service on 31.05.2011 as Accounts Supervisor. (4) The learned counsel for the petitioner submitted that as per BP.No.
Examination in Accountancy, who had obtained a degree from an University recognized by the University Grants Commisison. The learned counsel submitted that the petitioner had obtained B.Com., degree from Alagappa University, which is recognized by the UGC. The learned counsel contended that this Court in WP.Nos.7276 to 7278/2012, vide order dated 27.06.2012, held that passing Accountancy Test in Part III of the Intermediate Exam, has only a limited purpose and pursuant to the aforesaid judgment of this Court the Board vide Proceedings No.59, dated 24.05.2013, clarified the issue relating to possession of Open Univeristies Degrees without acquiring 10+2, for appointment or promotion and accepted the Board accepted such degrees for limited purpose. The learned counsel also submitted that pursuant to the proceedings dated 01.08.
2022, the Board granted promotions notionally to some of its left out employees as Accounts Supervisors/Assistant Accounts Officer, whose promotions had earlier been deferred and who had retired from service. The learned counsel further submitted that similarly placed persons filed WP.Nos.39206/2016 and 36511/2016 and 4059/2016 and this Court, vide orders dated 13.12.2022, 14.11.2022 and 18.11.2022, directed the respondents to extend the benefits of Board Proceedings dated 01.08.2022 to the petitioners therein and issued Memo dated 31.05.2024, granting notional promotion as Assistant Accounts Officer.
footing, is also entitled for such relief and in this regard, the petitioner had submitted a detailed representation dated 06.03.2025. However, the said representation is yet to see the colour of the day. Hence, the learned counsel prayed for appropriate orders.
(5) Heard Mr.R.Nikkhilesh Athav, learned counsel appearing for the respondents and perused the materials placed on record. (6) Though the petitioner has prayed for a larger relief, this Court, considering the facts and circumstances of the case, and without going into the merits of the case, directs the 2nd respondent to consider the petitioner's representation dated 06.03.2025, in the light of BP No.59, dated 24.05.2013 and in the light of the orders of this Court dated 13.12.2022, 14.11.2022 and 18.11.2022, made in WP.Nos.39206/2016 and 36511/2016 and 4059/2016, and the extant Rules, on merits and in accordance with law and pass appropriate orders within a period six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner herein.
