This petition has been filed seeking to grant leave to the petitioner to file the civil revision petition against the judgment and decree passed in O.S.No.541 of 2003 dated 09.01.2004 on the file of the Principal District Munsif Court, Cuddalore.

2. Learned counsel for the petitioner submitted that by an order dated 09.01.2004, the permission to sell the Trust properties was granted by the District Munsif Court, Cuddalore in O.S.No.541 of 2003. He further submitted that as per Section 22 of the Trust Act, the learned District Munsif does not have such power, whereas, the District Munsif has passed a decree. Therefore, the petitioner being the descendant of the beneficiary of the 1st respondent Trust, seeks leave to file the revision petition against the judgment and decree passed in O.S.No.541 of 2003.

3. In view of the above, the revision petitioner has made out a prima facie case. Therefore, leave is granted.

4. Accordingly, this Civil Miscellaneous Petition stands ordered. 14.08.2024 Note : Registry is directed to number the Civil Revision Petition, if it is, otherwise, in order.
