For Petitioner : Mr. W.Camyles Gandhi For Respondents : Mrs. A.Madhumathi, Special Government Pleader O R D E R This writ petition is filed for issuing a writ of mandamus directing the respondents herein to dispose of the petitioners' representation dated 21.03.2018, with respect to rectification of the patta Nos.326 and 161 in respect of the land situated at Lakkapuram Village, Namakkal Circle, Namakkal District.
2. The petitioner seeks modification of entries in Revenue records. In short the petitioner wants the names of certain people to be deleted in patta in respect of the property to which the petitioner claims ownership. Even though the petitioner seeks deletion of certain names from the revenue records in respect of certain lands, they have not been impleaded. When this Court wanted why the petitioner has not impleaded the private persons against whom he seeks relief, the petitioner's counsel stated that the petitioner is unable to get the address of those persons. The petitioner's counsel is not inclined to implead proper and necessary parties.
3. Therefore, this Court finds that the writ petition is liable to be dismissed on the ground that the proper and necessary parties are not added. The petitioner is permitted to file another petition on the same cause of action by impleading necessary parties. Learned counsel for the petitioner states that the petitioner may also be permitted to approach the Appellate Authority as the Tahsildar has now included the names of certain third parties on the basis of certain transactions without any proof to show that the vendors of such third parties are registered land owners. It is also open to the petitioner to file an appeal as against the entries.
