ORDER

The present Writ Petition has been filed challenging the order passed by the the Presiding Officer, Additional Labour Court, Vellore, in C.P.No.112 of 2012 dated 12.11.2014.

2. The second respondent, who was working as an Attender in the Petitioner Management, was dismissed from service on 13.02.1999. Challenging the order of dismissal, he raised an Industrial Dispute in I.D.No.277 of 1999 before the Presiding Officer, Additional Labour Court, Vellore and the same was allowed. Pursuant to the award passed in I.D.No.277 of 1999, the second respondent/workman filed a Computation Petition in C.P.No.188 of 2006 for computing the benefits due to the petitioner at Rs.2,51,675/- and got an award in his favour and the same was challenged by the petitioner Management by way of filing a Writ Petition in W.P.No.24691 of 2009 and the same was dismissed on 02.12.2009. Against which, the Management had filed a Writ Appeal in W.A.No.62 of 2010 and the same was also dismissed on 14.05.2016, which would amount to confirming the earlier award passed by the Labour Court in C.P.No.188 of 2006. As on the date of passing of the award in impugned C.P.No.112 of 2012, nothing was adverse to 2 of Page 4

the interest of the second respondent. Hence, I do not find any ground to interfere with the order passed by the Presiding Officer. Therefore, this Writ Petition is dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. 03.09.2024 asi To The Presiding Officer, Additional Labour Court, Vellore.
