Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 366(A) IPC, in Crime No.218 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner had kidnapped the minor daughter of the de-facto complainant, who is aged 17 years, for the purpose of marrying her. Hence the complaint.

3. The learned counsel for the petitioner would submit that there was a love affair between the petitioner and the de-facto complainant's daughter and the petitioner undertakes to marry the victim girl after she attains majority and there is no intention to cheat the victim girl. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) would submit that till now, the victim girl has not been secured. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5. Considering the nature of allegation made against the petitioner and also the victim girl has not been secured till now, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
