This petition is filed to condone the delay of 661 days in filing the appeal.
Heard Mr.M.R.Thangavel, learned counsel for the petitioners and Mr.N.Anbumurugan, learned counsel for the second respondent. Despite notice having been served upon the first respondent, none appears before this Court.
Learned counsel for the second respondent would submit that the delay may be condoned, however, the interest during the delay period can be waived.
Accepting the said contention raised by the learned counsel appearing for the second respondent, the delay of 661 days in filing the appeal is condoned with a condition that the petitioners cannot claim any interest during the delay period. Accordingly, the petition stands ordered.
