ORDER
This Criminal Original Petition has been filed to direct the second respondent Police to register a case on the complaint dated 24.05.2016, given by the petitioner and to investigate the same and file a final report.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that property in question belonged to one Chelladurai Pandian and that he had let out the property to the petitioner for running a hotel. The petitioner in turn had sublet the property to one https://hcservices.ecourts.gov.in/hcservices/
Srinivasan, who is running a hotel and that the said Srinivasan has now started paying the amount directly to the original owner Chelladurai Pandian, and hence the petitioner has come up with the present complaint.
4. The learned counsel for the petitioner submitted that the said Srinivasan is not a sub-tenant under the petitioner, but the petitioner has only permitted him to manage the affairs. Be that as it may, in a dispute of this nature, no positive direction can be given to the second respondentPolice to register an FIR, as these are matters to be decided by the Civil Court.
Hence, this Criminal Original Petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
