This application is filed by the fifth defendant in the suit seeking to produce an assignment deed dated 20.03.2009. It is stated that this document is not a new document but merely the final complete version of the first document produced by the defendant. The plaintiff opposes this application on the ground that the applicant is seeking to substitute the document that was previously produced.

Subject to production of the original for comparison, the applicant is permitted to exhibit this document subject to the objections of the respondent / plaintiff inter alia on grounds of admissibility, relevance and proof. The respondent / plaintiff is also permitted to file an affidavit of admission / denial in respect of this document. A.No.1913 of 2022 is allowed on these terms.
