Padmavathy (Alias) Padma v. Nandakumar And 9 Others

A.Nos.3091, 3095 and 3093 of 2023 in TOS No.1 of 2013 A.A.NAKKIRAN, J.

These three applications have been filed i) to condone the delay of 314 days in filing the application to set aside the abatement of the suit as against the sixth defendant, ii) to set aside the abatement of the above TOS 1 of 2012 as against V.Loganathan, the sixth defendant and iii) to bring on record the proposed respondents Mrs.Latha, Chandru, Sounther and Nandhini as the legal heirs of the deceased defendant V.Loganathan ranking them as defendants 7 to 10 in TOS No.1 of 2013

2. The learned counsel for the 6th respondent has no objection in allowing these three applications.

3. Being satisfied with the reasons stated in the affidavits filed in support of the applications, these three applications are allowed.

4. Learned counsel for the plaintiff is directed to carry out necessary amendment.
